Standard terms of use for TK's TK-App - valid until 8.1.2
Use of the TK-App is subject to the following general terms of use. Please read these terms of use carefully before using the app.
1. Principle
An Internet connection and a mobile device with an Android or iOS operating system are required to use the TK-App.
To log in to the TK-App, the online service "Meine TK" ["My TK"] is required. In the TK-App, content from the TK website can be displayed in so-called in-app browsers. Both "Meine TK" and the TK website are subject to separate terms of use and participation , which supplement these terms of use.
The TK-App enables the services of third parties to be accessed and also allows authentication for such services. TK merely provides access to these offers without being the actual provider. The separate terms of use of the respective provider apply to their use. Corresponding offers within the TK-App are expressly marked as such.
2. Data privacy
Personal data is transmitted or made available with the TK-App. For this purpose, you provide TK with your consent that the transmitted information may be used in accordance with the regulations on data privacy.
3. Security measures
Due to the sensitivity of your data (including your health data), the TK-App features various security measures and procedures:
3.1 Login and device registration
To log in to the TK-App, use the same user ID and password as for "Meine TK". If you do not yet use this online service, you can register at any time free of charge.
You must ensure that no third party gains unauthorised knowledge of the user ID and password. If you suspect that someone has gained unauthorised knowledge of your access data or that they are being used without authorisation, you must inform TK of this immediately by calling 0800 - 285 85 85 (free of charge within Germany) or by sending an e-mail to service@tk.de. TK does not assume any liability for damage that arises due to a breach of the aforementioned duties of care.
When you log in to the TK-App for the first time, you will be prompted to pair the TK-App with the device (so-called device registration). Otherwise, the TK-App cannot be used for security reasons. To do this, use your personal activation code, which we will send to you by post. Make sure you keep this code in a safe place. You will need it, for example, if you want to register a new device.
Only one device can be registered. You can view and delete the registration of your device at any time in the TK-App device management.
3.2. Measures taken by the TK-App to protect your data
In addition to the security procedures described in Section 3.1, the TK-App contains further mechanisms to protect your data.
Manipulation and customisation of devices and software
For security reasons, manipulated or highly customised devices and software (e.g. custom ROM, root, jailbreak) are not permitted for the use of the TK-App. Please make sure that your device uses original software and that no apps are installed that affect the device integrity and security. We reserve the right to exclude you from using the TK-App in these cases.
Permitted operating system versions
Use of the TK-App is only permitted with the officially published versions of the Android and iOS operating systems, and any use with beta versions of the operating systems can be excluded by TK. The supported operating systems with which the TK-App can be used are determined by TK. For security reasons, we are gradually excluding older versions of operating systems. This may mean that you can no longer use the TK-App if you are using an older operating system version.
Encryption
All data that is temporarily displayed or transmitted in the TK-App is encrypted and protected according to the current state of the art.
Automatic logout in case of inactivity
In a similar way to banking apps, the TK-App logs you out automatically if you do not use the TK-App for some time or leave it open in the background. This automatic logout takes place after ten minutes.
3.3. Your security precautions
As a user of the TK-App, you contribute to the security of your data:
Measures to take if you lose your smartphone
If you lose your smartphone, you can delete the registration of your mobile device for the TK-App at any time online via the TK-App device management in "Meine TK". Access to the TK-App and thus to your data is then no longer possible, even with your access data.
Device lock and manual logout
Use a device lock with passwords, PINs, patterns or biometrics to ensure that your data in the TK-App is protected from access by third parties before the automatic logout. A secure password contains upper- and lower-case letters as well as numbers and at least one special character. It should also have no reference to your person, such as your name, address or date of birth. When creating a PIN, make sure that you choose different, non-consecutive digits and that they are not digits that can be easily guessed, such as your date of birth.
Due to the sensitivity of your data (e.g. health data), we recommend that you always log out of the TK-App manually once you have finished using it. This is possible at any time using the "Log out" menu item in the main navigation.
Updating the operating system
Please update the operating system of your smartphone regularly so that the latest security updates are always installed.
4. Advertising and content quality
The content of the TK-App is subject to strict quality criteria. It is free of advertising. It is financed exclusively by TK’s own funds and does not rely on sponsors.
5. Warranty
The TK-App is provided with the exclusion of any warranty for its correctness, completeness or its suitability for certain purposes. TK makes every effort to ensure that it is always up to date, but is under no obligation to update the content of the TK-App.
TK does not guarantee accessibility, technical usability and freedom from malware of the TK-App, the content or the transmitted data. TK is not liable for technical faults on your device or malfunctions of the TK-App.
6. Liability
With the exception of the aforementioned warranty limitations, the statutory provisions on liability shall apply.
7. General information on medical content
Medical content in the TK-App represents information on the subject of health and is intended solely for informational use. Medical knowledge is subject to ongoing change through research and clinical experience. The content creators and experts take great care to present factual information in a form that is understandable to laypersons. The information is not a substitute for consultation or treatment by a licensed medical professional or for the advice of pharmacists.
Furthermore, these contents are not suitable for making independent diagnoses or starting treatments. Nor may the information or statements provided be understood as a prompt for a specific treatment or non-treatment of a possible disease. Diseases and other conditions can only be diagnosed and treated by consulting a licensed medical professional.
Moreover, the information must never be understood as a prompt for self-treatment or self-diagnosis of a disease or other condition. The information only serves to prepare for a visit to a medical consultation or to assist in following this up.
