Standard terms of use for TK's TK-App - valid since 8.2.0
Use of the TK-App is subject to the following standard terms of use. Please read these terms carefully before using the app.
Principle
The TK-App is TK’s free information and service offering. In order to use the TK-App, insurees must be registered for and have access to "Meine TK".
Content from the TK website can be displayed in in-app browsers in the TK-App. Both "Meine TK" and the TK website are subject to separate terms of use and participation , which supplement these terms of use.
The TK-App enables the services of third parties to be accessed and allows authentication for such services. TK merely provides access to these offers without being the actual provider. The separate terms of use of the respective provider apply to their use. Such offers within the TK-App are expressly marked as such.
Device registration
The use of the TK-App is exclusively personal. When installing the TK-App, you will be asked to register your end device. You can select one of the methods offered for identification purposes. For security reasons, the TK-App cannot be used without registering the device. You can view and delete the registration of your device at any time in the TK-App device management.
Permitted operating system versions
Use of the TK-App is only permitted with the officially published and licensed versions of the Android and iOS operating systems. TK stipulates the supported operating systems upon which the TK-App can be operated.
For security reasons, older operating systems as well as older versions of the TK-App will be gradually phased out. This may mean that in order to continue using the app you may have to perform an update if you are using an older version of your operating system or of the TK-App.
Manipulation and customisation of devices and software
For security reasons, manipulated end devices and software (e.g. custom ROM, root, jailbreak) are not permitted for the use of the TK-App. Please make sure that your device uses original software and that no apps are installed that affect the device’s integrity and security. We reserve the right to exclude you from using the TK-App in such cases.
Duties of care and cooperation of the user
You are obliged to ensure that no unauthorised third party gains possession of the password or other identification means that allow access to "Meine TK" or the TK-App. If unauthorised third parties gain access to your password or other identification means, it is generally not possible for TK to prevent misuse of access and avert damage. You can lock your "Meine TK" account with your telephone at any time or delete the device registration via tk.de if you lose your mobile device.
Use a screen lock with a secure unlocking mechanism on your mobile device to protect your data from third-party access. We recommend that you always log out of the TK-App manually after completing your request.
Disclaimer of warranty
The contents in the TK-App are provided without any warranty for their accuracy, completeness, or suitability for specific purposes. TK makes every effort to ensure that it is always up to date, but is under no obligation to update the contents of the TK-App.
TK is not liable for technical disruptions on your end device or failures of the TK-App.
General information on medical content in the TK-App and in special online offers
With the medical content in the TK-App and the online services provided within it, TK aims to offer its insurees, interested parties, and all citizens the opportunity to inform themselves about medical issues. To this end, TK provides them with quality-assured information on diseases, diagnostic and treatment methods, as well as general tips for the body and mind.
The medical content represents information on health topics and is intended solely for informational use. Medical knowledge is subject to continuous change due to research and clinical experience. Professionals, authors, and editors take great care to present factual information in an understandable form.
However, the information does not replace consultation or treatment by licensed doctors. It does not substitute the advice of medical or pharmaceutical professionals under any circumstances. Furthermore, the contents of this app are not suitable for making independent diagnoses and should never be understood as an invitation to self-diagnose or treat an illness or other ailment.
Right of amendment
TK will inform you of changes to the terms of use in a clear and unambiguous manner. If your consent is legally required, the changes will become effective immediately after you accept them, but no earlier than the date or version of the TK-App specified in the notification. If you do not agree, you will no longer be able to access the version of the TK-App to which the change in terms of use applies.
TK is entitled to amend these terms of use without your consent if, for example, legal requirements which do not require consent, technical changes, or additional service offerings are implemented or introduced. If such a change affects the mutual services of the parties, TK's unilateral right of modification exists only if the change is reasonable for you, considering your interests.
Therefore such a right to unilaterally amend the terms of use exists particularly if:
a) the change to the terms of use only benefits you;
b) the change only relates to new functions, services, or service components and does not affect the valid service and contractual relationship;
c) the change is necessary to implement applicable legal requirements (e.g., due to changes in the applicable legal situation) and the change has only insignificant adverse effects on you; or
d) TK complies with a binding administrative decision or a binding court ruling, and the change has only insignificant adverse effects on you.
